Terms of Service

Agreement

By using PeakGauge, you agree to these terms. PeakGauge is operated by RingerRival LLC. If you do not agree with any part of these terms, do not use the service.

The Service

PeakGauge is a business intelligence dashboard that turns your business data into key performance indicators and a Business Health Score. Today, data is imported from CSV files; connections to Square and QuickBooks are planned. The service is provided “as is” and is intended for informational purposes.

Your Account

  • You must provide accurate information when creating an account
  • You are responsible for keeping your login credentials secure
  • You must be at least 18 years old to use PeakGauge
  • One account per business (multiple users share an organization account)
  • You are responsible for all activity under your account

Subscriptions and Payments

  • Early access: PeakGauge is currently free and paid plans are not available. Before we introduce any paid plan we will give you at least 30 days' notice by email, and you will only be charged if you choose to subscribe. The terms below apply once paid plans are available
  • Free plan: no payment required, limited features
  • Pro plan: billed monthly, in advance, at the price shown on the pricing page when you subscribe
  • Automatic renewal: your Pro subscription renews automatically every month and you will be charged each month until you cancel
  • You can cancel at any time from Settings → Manage billing. Cancellation takes effect at the end of your current billing period, and you keep Pro access until then
  • Prices may change with at least 30 days' notice to existing subscribers; you can cancel before the new price applies
  • If a payment fails, your account may be moved to the Free plan until the payment succeeds

30-Day Money-Back Guarantee and Refunds

  • 30-day money-back guarantee: if you are not happy with Pro, email support@peakgauge.app within 30 days of your first Pro payment and we will refund that payment in full. No reason is required
  • The guarantee covers the first Pro payment for each business, once. It does not apply again if you cancel and subscribe later
  • When we issue a guarantee refund, your Pro subscription is cancelled immediately and your account moves to the Free plan. Your data stays in your account
  • Outside the guarantee, payments are non-refundable: we do not provide refunds or credits for renewals, partial months, unused time, or downgrades from Pro to Free
  • Cancelling stops future charges; you keep Pro access until the end of the paid month
  • Deleting your account cancels your subscription immediately and ends Pro access at that moment. Remaining time in the current billing period is not refunded, except under the 30-day guarantee (email us within the 30 days)
  • This does not limit any refund you are entitled to under applicable law

Your Data

  • You own your business data. We do not claim any ownership.
  • You grant us permission to process your data to provide the service (display metrics, generate insights, send digests)
  • You can request an export of your data at any time by contacting support (self-service export is coming soon)
  • You can delete your account and all data at any time
  • See our Privacy Policy for how we handle your data

Integrations

  • When available, PeakGauge will connect to third-party services (Square, QuickBooks) via their official APIs
  • We request the narrowest permissions each provider offers and only read data - PeakGauge never modifies your data in those systems
  • You will be able to revoke integration access at any time from Settings
  • We are not responsible for outages or changes in third-party services
  • If Square or QuickBooks changes their API, some features may be temporarily unavailable

Insights and Recommendations

  • PeakGauge calculates scores, trends and alerts from your data using fixed rules (for example, comparing your numbers with targets)
  • These are informational, not financial, tax, or legal advice
  • You should use your own judgment before acting on any recommendation
  • We do not guarantee the accuracy of calculated results, which depend on the data you provide
  • Daily brief: a one- or two-line summary of your numbers at the top of the dashboard. It is written either by fixed rules or, when AI summaries are switched on, by an AI model from the same calculated numbers. An AI-written brief is labelled "AI" and may contain mistakes; the KPI cards show the exact figures
  • Your data is not used to train AI models

Acceptable Use

You agree not to:

  • Use the service for any illegal purpose
  • Attempt to access another user's data
  • Reverse-engineer, scrape, or probe the service for vulnerabilities
  • Upload malicious files or attempt to compromise our systems
  • Resell access to PeakGauge without authorization
  • Use automated tools to create fake accounts

Service Availability

We aim for high availability but do not guarantee 100% uptime. We may perform maintenance with reasonable notice. We are not liable for losses caused by service interruptions.

Limitation of Liability

PeakGauge is a data visualization and insights tool. We are not a financial advisor, accountant, or business consultant. To the maximum extent permitted by law:

  • We are not liable for business decisions made based on PeakGauge data or recommendations
  • We are not liable for inaccuracies in data received from third-party integrations
  • Our total liability is limited to the amount you paid us in the 12 months prior to the claim
  • We are not liable for indirect, incidental, or consequential damages

Termination

  • You can close your account at any time from Settings
  • We may suspend or terminate accounts that violate these terms
  • Upon termination, your data is deleted within 24 hours
  • Sections on liability, data ownership, and disputes survive termination

Changes to Terms

We may update these terms. Material changes will be communicated via email at least 30 days before taking effect. Continued use after changes constitutes acceptance.

Governing Law

These terms are governed by the laws of the State of Texas, United States. Any disputes will be resolved in the courts of Travis County, Texas.
